1. Agreement to Terms

These Terms of Service ("Terms") form a legal agreement between you and Roberts MapleVale Retail LLC ("Company", "we", "us" or "our"), the operator of MapleVale Arcade at obertsmaplevale.com and the games offered on it (together, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for a general audience. If you are under the age of majority where you live, you may use the Service only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf.

3. The Service

MapleVale Arcade provides free casual mini games that run in a web browser. We may add, change, suspend or remove any game or feature at any time, with or without notice. We do not guarantee that the Service will always be available or free of errors.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to access and play the games for your own non-commercial entertainment. You may not:

5. Intellectual Property

The Service, including all games, graphics, text, logos, the "MapleVale Arcade" name, software and other content, is owned by or licensed to Roberts MapleVale Retail LLC and is protected by United States and international copyright, trademark and other laws. All rights not expressly granted to you are reserved.

6. Feedback

If you send us ideas, suggestions or other feedback, you agree that we may use it without restriction or compensation to you.

7. Purchases

All games currently offered on the Service are free. If we introduce paid features in the future, the price, payment terms and refund rules will be shown clearly before you buy, and those additional terms will apply to the purchase.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle information.

9. Third-Party Links

The Service may link to third-party websites or services that we do not control. We are not responsible for their content, policies or practices.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROBERTS MAPLEVALE RETAIL LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

12. Indemnification

You agree to defend, indemnify and hold harmless Roberts MapleVale Retail LLC from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.

13. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms. Sections that by their nature should survive termination will survive, including Sections 5, 10, 11, 12 and 14.

14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to its conflict of law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Fayette County, Kentucky, and you consent to the jurisdiction of those courts. Before filing a claim, you agree to first contact us at legal@obertsmaplevale.com and try to resolve the dispute informally for at least 30 days.

15. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. By continuing to use the Service after changes take effect, you agree to the revised Terms.
